1. Introduction

Flexible RE Company LLC (“Flexible”, “we”, “us” or “our”) respects your privacy.  This Privacy Policy describes how we collect, use, and disclose personal and other information about you that we collect through our website (flxbl.com) (our “Site”), from our affiliates, when you contact us via telephone, our email messages to you and when you access our online services (collectively, the “Services”). 

Personal information is information that identifies you as an individual. The categories of personal information we collect may include, for example, your name, phone number and email address and information about the device you use to access and use the Site and Services.  If you submit any personal information relating to other people to us in connection with the Site or Services, you represent that you have the authority to do so and to permit us to use the information in accordance with this Privacy Policy. We do not request to knowingly collect “sensitive” or “special categories” of personal information.

This Privacy Policy is incorporated into and is part of our Terms of Service.  By providing your personal information to us, you agree to the terms and conditions of this Privacy Policy. If you do not agree with the terms and conditions described below, you should not use the Site or Services.

2. The Kinds of Information We Collect

a. Information You Provide Voluntarily

We collect content, images, and other information you provide to us when you access our Services, including when you complete webforms on Site, ask for us to contact you, participate in our “Live Chat”, send us an email message, answer a questionnaire or survey, otherwise engage with us through our Site or Services.  When you upload photos of your property to our Site, we can see the photo and the metadata that accompanies the image file. Please do not upload photos of yourself, other people or containing other personal information

Categories of personal and other information you may choose to provide to us include:

  • Your name, address, telephone number, and e-mail address;

  • Your account log-in details;

  • Financial information, including bank account and real estate financing information;

  • Details about your property, surrounding properties and neighborhood;

  • Circumstances related to your purchase or sale of a property that might help us tailor our Services to you;

  • Properties you visit or view on our Site and your opinions about those properties;

  • Reviews or comments you leave on our Site, or on other public websites;

  • Your driver’s license or state ID information;

  • Real estate offer letters;

  • Citizenship status (for tax calculation purposes); and

  • Marital status (for tax calculation purposes).

b. Information We Collect Automatically

We may collect the following information regarding the device that you use to access our Site and Services:

  • Device attributes such as the operating system, hardware and software versions, battery level, signal strength, bandwidth, available storage space, browser type, app and file names and types, and plugins;

  • Information about operations and behaviors performed on the device, such as mouse movements (which can help distinguish humans from bots) or whether a window is in the foreground or background;

  • Identifiers unique to you, your device, or your account(s), such as device IDs, advertising IDs, and other similar static ID numbers such as those from apps or accounts you use;

  • Information you allow us to receive through device settings you turn on, such as access to your GPS location;

  • Network and connection information such as the name of your internet service provider, language, time zone, phone number, and IP address; and

  • Data from cookies, tags, pixels, web beacons, and log files stored on your device, including cookie IDs, page views, how often you visit our Site or use the Services, and links you click on. Please note our Site does not currently support Do Not Track signals from your browser.

We generally use this information for your convenience and to improve our Services. For instance, we may use it to: (i) remember your information so that you do not have to re-enter it; (ii) provide you with customized content and information, including targeted online advertising; (iii) monitor the effectiveness of our Services; (iv) monitor aggregate metrics such as total number of visitors, traffic, and usage patterns; and (v) diagnose or fix technology problems. If you wish to opt out of cookies or targeted online advertising, please see the Section 6 (“Your Choices”) below.

c. Information We Collect When You Call Us

We may record telephone calls between you and our customer service team. We do this to make sure we provide you with the best possible service. Our customer service team members also enter certain information you provide into our customer service databases to ensure continuity and consistent service. 

d. Information We Collect from Partners, Service Providers, and Affiliated Businesses

We may collect information about you from our partners, service providers, and affiliated businesses in order to provide the Services, real estate agent partnership programs, and, in cases where we are not able to complete a transaction with you, access to other potential purchasers or brokers, or to listing agents who may be able to help with your property sale. Information we gather about you from our partners, service providers, and affiliated businesses may include:

  • Information about your property from listing or other property information websites and applications;

  • Construction or purchase contracts (with your consent);

  • Information related to completion of the construction of your new property (if you are working with a builder and you agree);

  • Information about the condition of, and repairs to, your property and property;

  • Information related to your property purchase, sale, moving dates, and financing in connection with helping us facilitate any of our “Offer Types”; and

  • Information about how you may have engaged with advertisement or social media post from us.

e. Information We Collect from Public Sources

Much of the information necessary to help you buy or sell your property is available from public government and other public sources. We sometimes collect information from these sources so that you do not have to spend time looking for and aggregating it for us. For example, we may collect the following information about you and your property from public sources:

  • Tax assessments of your property;

  • The school district and public transportation available near your property;

  • Information contained on the deed to your property, such as name, address, liens, encumbrances, and title;

  • Sale prices of properties similar to your property (called “comparables");

  • The number of bedrooms and bathrooms in your property;

  • Whether your property has access to features like a beach, boat dock, or parking garage;

  • Whether your property is in an earthquake or flood zone or has any other condition that would affect its market value;

  • Permits issued for remodels and additions;

  • The finished and unfinished square footage of your property; and

  • The year your property was built.

3. How We Use Your Information

a. To Provide Our Services to You

We use the information that we collect about you to deliver our Services, including to personalize features and content to you. We use the information you provide to give you options for buying and selling your property that may be relevant to your individual circumstances. As discussed in more detail below, you have choices about how and whether we process your personal and other information. 

b. To Learn About Your Property for a Possible Transaction

We use information you provide to us about your property or the type of property you are interested in for a possible transaction and, in some cases, combine it with information from property listing information providers,  and public property and tax records to help us provide the Services to you. For example, before you sell your property to us, we will examine photos of your property that you upload and review information about the condition of your property provided to us by our property inspectors.

c. To Advertise Our Services

We may use information collected about you to provide you with relevant information about additional Services that we or our affiliated companies offer.  For example, we use information about how you interact with our Site and Services, combined with information you provide us and information we collect from other sources, to serve you relevant targeted online advertising. 

d. To Do Market Research

We are constantly striving to improve our customer experience. We conduct research into all aspects of the property buying and selling process to try to identify ways to make it better. Sometimes we use partner companies to conduct surveys of willing participants who offer suggestions as to how we might improve our Services. We also aggregate and analyze consumer information that we collect on our Site and Services, and from conversations with our customer service representatives to identify trends which inform how we change and grow.  

e. To Support Information Security and Debugging

We may use information about you and your use of the Site and Services to detect security incidents, protect against malicious, fraudulent, or illegal activity, and improve the security of our network and systems. We may also use this information to debug our Site and Services to identify and repair errors that impair existing intended functionality.

f. To Conduct Analytics

We also gather statistical and analytics information about the usage of the Site and Services in order to continually improve their design and functionality, to understand how they are used, and to assist us with resolving technical questions.  In most cases, no personal information is used to provide these analytics, although aggregated or anonymous information may be shared.

g. In Connection with a Dispute

We may use personal information to prosecute or defend against claims in court and other dispute resolution forums.

h.  Aggregate/Anonymous Information

We reserve the right to create aggregate or anonymous information based on your personal information.  We cannot identify you from aggregate or anonymous information.

i. Other

As we believe to be necessary or appropriate, we may use your personal information to: (i) to comply with legal process; (ii) to respond to requests from public and government authorities including public and government authorities outside your country of residence; (iii) to enforce our terms and conditions; (iv) to protect our operations; (v) to protect our rights, privacy, safety, or property, and/or those of you or others; and (vi) to allow us to pursue available remedies or limit the damages that we may sustain.

4. Why and How We Share Your Information

a. With Your Consent

We may share your information when you specifically direct us to do so. Examples of situations where we share your information with your consent include:

  • Partners. We work with property owners, real estate agents and other active real estate owner-operators and participants. We may share your information with our partners, to the extent you’ve specifically authorized us to do so, in order to pair you with a real estate agent who can help you through the property buying or selling process.

  • Service providers. If and to the extent you authorize us to do so, we may share your information with various service providers, such as those providing financial services or conducting analytics of our Site or Services.

  • Escrow and title. With your consent, we may share your information with property escrow and title insurance providers.

b. With Our Affiliated Companies

We may share your information between our affiliated companies to the extent allowed by law.

c. With Service Providers Who Facilitate Our Ability to Provide You with the Services

We may share your information with third-party service providers, including payment processors, technology and infrastructure providers, digital communications services, commercial data and market research analysts, consumer report providers, auditors and accountants, physical site security providers, IT security and bug-fix partners, and other providers and advisor, who perform services for and on behalf of us for the sole benefit of us and our customers.  These service providers are legally required to protect the privacy of our customers.

d. With Law Enforcement, Courts, or Government Agencies

We may share your information as necessary to respond to legal process or to regulatory authorities (such as pursuant to a subpoena, warrant, investigative demand from law enforcement, regulators, or others; national or international security letters; etc.); to investigate, prevent, or take action regarding suspected or actual illegal activities (including fraud or stalking) and security or technical issues; to respond to or participate in commercial disputes (e.g., lawsuits or investigations); or to protect against fraud, claims, or other liability or harm to you, us, or others.

e. As Part of a Transaction for Our Business

We may share your information to a third party in the event of any reorganization, merger, sale, joint venture, assignment, transfer, or other disposition of all or any portion of our business or assets (including in connection with any bankruptcy or similar proceedings).

f. “Selling” Your Personal Information

We may share your information with third parties not owned by or related to us.  We may also enter into a co-branding arrangement with third parties to offer a new service or product.  In these cases, we may receive payment or some benefit from these third parties for sharing personal information.  You can opt out of the sale of your personal information, as described in section 6 below.

5. How We Protect Your Information

a. Security

We have implemented commercially reasonable measures to protect personal information within our organization.  However, no data transmission through the Internet, or even the physical transfer of information, can be guaranteed to be completely secure. We cannot fully eliminate all security risks associated with your transmitting personal information to us. We do not ensure or warrant the security of any data or information you transmit to us, and you do so at your own risk. Certain areas of the Site or Services may require the use of a user ID, email address, and/or password as an additional security measure to help protect your information.  Please do not provide your password to another person.  We cannot be responsible for a data breach or other incident if a password is used by unauthorized persons.

In the event that the security of any personal information under our control is compromised, we will take reasonable steps to investigate and mitigate the situation, including, when appropriate, notifying those individuals whose information may have been compromised and taking other steps in accordance with applicable laws and regulations.

b. Retention

We will retain your personal Information only for the period necessary to fulfill the purposes outlined in this Privacy Policy unless a longer retention period is required by law. When there is no longer a legitimate need to retain your information, we will securely delete or anonymize it, or if this is not possible, securely store it until deletion is possible.

c. Third Parties

This Privacy Policy does not address, and we are not responsible for, the privacy, information, or other practices of any third party operating any site or service to which the Site or Services may link. Please remember to review the privacy settings and security policies of third-party sites and services that you use, such as social networks. We are not responsible for the privacy or security measures of any third party.

6. Your Choices

a. Withdrawing your consent

You may notify us at any time that you wish to withdraw or change your consent to our use and disclosure of your information. We will accommodate your request subject to legal and contractual restrictions.  To withdraw or change your consent, send us an email at hello@flxbl.com.

b. Sale of Personal Information

You may request to opt-out of the sale of your personal information by emailing us at hello@flxbl.com. We will respond to a request to opt-out of future sales within fifteen days after we receive it. 

c. Request to Know or Request to Delete Personal information

You can request to know what personal information we have collected about you or to request that we delete this information from our systems and databases.  To make these requests, please email us at hello@flxbl.com and include either “Request to Know” or “Request to Delete” in the subject line of your email.

d. Marketing Communications

You can opt out of receiving marketing emails from us at any time by clicking the “Unsubscribe” link at the bottom of each email or emailing us at hello@flxbl.com with the word UNSUBSCRIBE in the subject field of the email. Please note that even if you unsubscribe or opt-out, we may still send you transactional, order, or other administrative related communications related to services you have requests or other non-marketing messages. 

e. Cookies and Targeted Online Advertising

If you do not want information collected through the use of cookies, you can decline cookies; however, if you do not accept these cookies, you might experience some inconvenience in your use of the Site or Services. Cookies can be removed by following your web browser’s directions. You can find out more information about how to change your browser cookie settings at www.allaboutcookies.org.

Our advertising partners may also use cookies to serve you targeted online ads based on your web browsing history and other data.  You can adjust your browser settings to opt out of receiving these types of ads. To do so, click on the instructions from the Digital Advertising Alliance at https://youradchoices.com/control.  Note, however, that opting out does not mean you will continue to receive online advertising; you will receive generic ads.

7. Non-Discrimination

We will not discriminate against you for exercising any of your rights by exercising any of your choices regarding your personal information. Unless otherwise permitted by law or there is a legitimate business reason for doing so, we will not:

  • Deny you goods or services;

  • Charge you different prices or rates for goods or services, including through granting discounts or other benefits, or imposing penalties;

  • Provide you a different level of quality of goods or services; or

  • Suggest that you may receive a different price or rate for goods or services or a different level or quality of goods or services.

8. Children’s Personal Information

The Site and Services are directed to adults 18 years and older.  We request that minors younger than 18 not provide any personal information through the Site or Services.  In the event that we learn that we have collected personal information of minors, we will delete that information promptly. If you believe that we might have any personal information from a minor, please contact us at hello@flxbl.com so that we may delete it.

9. Located in the United States

Flexible is located in the United States and the Site and Services are controlled and operated from the United States and are intended only for users in United States. 

10. Changes to this Privacy Policy

We reserve the right to amend the Privacy Policy at any time, for any reason. The date of the last revision to this Privacy Policy will be indicated by the “Last updated” date at the bottom of this page. Any changes to this Privacy Policy will become effective when we post the revised Privacy Policy on the Site. Your use of the Site and Services following these changes means that you accept the revised Privacy Policy.
